General :
The terms and conditions specified here administer the use of the services provided by Disung Infosys. These terms and conditions shall apply to all individuals or entity who wants to avail the services of Disung Infosys.
You are requested to read the terms and conditions very carefully. Once you register and avail the services of Disung Infosys, you shall, in all circumstances comply with the provisions of the terms and conditions provided. Disung Infosys reserves the right to terminate the contract or stop the services providing to the clients for any conduct which Disung Infosys believes to be harmful for its business or the use of the service is harmful to others.
Disung Infosys holds a right to modify or change the terms and conditions at any time, at its sole discretion, without any notice. Such modification or changes shall be made effective for all the clients after it is being informed in the website. Responsibility lies on the clients to read the terms and conditions from time to time to make sure that their service is in compliance with the terms and conditions.
Terms and Conditions :
1. Disung Infosys pledges to impart quality services to the clients who want to avail it, to proceed with the services as per the project requirement, 50% of the total amount of the project is to be paid as a booking charge mandatorily.
2. There is a fixed design structure in terms of the admin panel, member panel, franchise panel and re-purchase system that will be developed in accordance with the first quotation of the project and cannot be changed once the order is placed. However, the clients will be able to change the color and functionality of the software only.
3. If in case the client wants to make changes in the structure of the design of the software, they have to pay a higher amount for which a revised quotation will be send to the client and have to inform us about the intention to change the structure prior to placing of the order.
4. A validity of 7 days will be offered to the clients to make the payment, which will be counted from the date mentioned in the quotation.
5. Disung Infosys will try their best to deliver the project to the client on the decided date. However, the date might change in compliance with the changing demands and requirements of the clients.
6. There is an annual maintenance charge, which is 30% of the total amount of the software that the client is required to pay. This annual maintenance charge is mandatory and has to be paid prior to 1 week of the expiry of the software.
7. The quotation of the project that will be submitted to the client does not include the source code.
8. If, in any case, the client makes a demand for extra modules, the client is required to pay an extra charge accordingly.
9. The client has to pay 5 times of the quoted price of the software if he wants to have the source code.
10. Once Disung Infosys delivers the entire project to the client, they cannot demand a refund if they are not satisfied with the project results.
11. Third party integration on clients demand is chargeable and the charge shall not be included in the quotation. This has to be paid separately by the client.
12. Any demand of add on modules are charged extra which is not included in the quotation.
13. The payment from the client has to be made in the mentioned account address. For any payments made in personal accounts or otherwise will be deemed as non-payment and for any other replacement of payments we would not hold any responsibility.
14. The phase wise quotation that Disung Infosys will submit to the clients will be including GST.
15. The time of delivery of the project is counted within business days, no holidays or Sundays are included.
16. Disung Infosys provides the following components along with the software. They are:- website design, video presentation, software, domain registration, server, android application, SSL certificate, business PPT, 1 year technical support, DDOS protection, live chat, premium logo, unlimited business email, product or service brochure, unlimited video presentation, 3000 promotional SMS.
17. The above mentioned components are provided by Disung Infosys as correlated services with the software
18. The work on the first phase of the project will be started as soon as the client pays the 50% of the total amount. After the first phase is complete, Disung Infosys will provide services which are: – software, domain registration, server, business server, 3000 promotional SMS, unlimited business email, premium logo.
19. Once the first phase of the project is complete, the client shall make the payment for the second phase to proceed with further work on the project. Disung Infosys will take 3 days, after receiving the payment, to complete and deliver the work. Disung Infosys will provide services in the second phase which are:- android application, SSL certificate, business PPT, PDF brochure, animated video, presentation, DDOS protection, live chat, technical support for a period of 1 year.
20. Once the client pays the booking amount, the work on the first phase starts and after the completion of the first phase of the project, the client cannot reject to pay for the 2nd phase. In this case, we reserve the right to suspend the software.
21. The quotation of the project submitted to the client is entirely of the software which excludes the components mentioned earlier, therefore no client can reject the components and demand to negotiate the price of the software. For Example, if the quotation states 40k for the software then the client has to pay 40k irrespective of the components.
22. Client cannot make a demand to negotiate the price of the software on the ground of not accepting the components. He has to pay the full price that is quoted according to the project requirements.
23. Disung Infosys provides- a one minute video presentation, PPT (which shall not exceed 10 numbers), PDF brochure (not exceeding 10 numbers) along with the delivery of the software for once. If, in any case, the client wants more of these services, than the client has to pay extra according to the requirement of the services.
24. Disung Infosys is open to work on and accept changes specified by the client in the project twice at maximum. Disung Infosys will not entertain any changes offered by the clients which exceeds two times.
25. No technical support is to be provided to the clients on official holidays.
26. It is to be noted by the clients that any misconduct or inappropriate behavior from the clients towards Disung Infosys or its associates will result in termination of the contract.
27. If a client requires the server or c panel details, they will get decrypted software with payment of 5 times the quoted price. Otherwise they will get encrypted software.
28. Disung Infosys offers to provide 1 year of technical support to the client after the delivery of the software.
29. The contract stands terminated if the client gets hold of the C panel details.
30. In scenarios where the client wants to come in association with Disung Infosys again after the termination of the contract (for any reason) earlier, than the client shall have to pay 10 times of the quotation which was provided earlier.
31. THE COMPANY PROVIDES THE SERVICE ON AN “AS IS” AND “AS AVAILABLE” BASIS AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE SERVICE (INCLUDING ALL CONTENT CONTAINED THEREIN), INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON INFRINGEMENT.
32. Disung Infosys shall not be held liable, whatsoever, where the client uses the software developed by Disung Infosys for any unethical, illegal or fraudulent work. We only develop the software and deliver it.
